type='text'>The Hacktivism and Copyright</title><content type='html'>By Clara Costa &amp; Francisco Tovo&lt;br /&gt;&lt;br /&gt;Can be understood as "hacker" an individual who holds the knowledge to develop, change and modify computer software through the binary system, the language from the machines. The reputation that precedes the term hacker is not the most pleasant. Sure, myth involves the meaning, in part thanks to the film industry and mainstream media. For much of the population, a hacker is a malicious individual can circumvent security systems in search of their own benefit. In the movie "Hackers", 1995, hackers are viewed as extremely intelligent individuals who use their knowledge to get around systems and obtain financial and personal favoritism. Made famous in Hollywood, the hype the film portrays a misunderstanding on the part of society on the hackers. Fortunately, most of these individuals, who have knowledge enough to be considered hackers, engages in the development of free software and other tools in which the use can bring benefits to all web users. In the words of Martin Dalton: "The hacker has a way of being, has a focus, has an interest. Like to experience the challenges and enjoy learning with their own limits. But one point that differs fundamentally from the hacker other people who like a challenge is that the hacker uses a significant portion of his time documenting and sharing how he managed to win a challenge and thus allows others to learn with their findings. It is an attitude that has its DNA in an inner desire to build a world from a collective intelligence from the collaboration between the different ways that people have to solve their problems. In that sense we can consider a hacker a social agent, whose actions can generate shared knowledge from the complex political actions. You can open a parallel between the hacker culture and counter culture punk. The punk movement emerged in late 70's. Both movements share a sense of resistance as an alternative society. Punks were known by their dress and customs that were punished in some way by the existing society do not fit the standards of the time. Outside of fashion, and marginal for excellence, not the criminal sense, but rather to live at the margins of society, punks influenced generations through music, behavior and attitude. Like the punks, but still at an embryonic stage, the hackers working the margins of society and resistant to the capitalist market behavior that weaves its tentacles over the Internet. The action of hackers is different, much more sophisticated, but no less effective. The goals of both groups appear to approach. As previously mentioned, most hackers free deals to share knowledge with society, a way to resist the current capitalist culture where everything must have a price. Coincidentally, both the hacker culture and the punk movement, assert themselves through the existing social parameters that fit the season. The punk movement emerged in the late '70s, a time marked by the rise of consumerism. The representation of this age could be evidenced by fashion. Since the hackers come up with strength, called the Information Age, and the principal assertion of them is through the sharing of information and knowledge.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Hacktivism - The Pirate Bay and discussion of intellectual property&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Hacktivism is the political and social activism, made through digital media. Many hackers have acceded to this position as a way of expressing their political opinions. When Loyd Blankenship wrote in 1986, the essay "The Hacker Manifesto" there may be a case of hacker activity such as social movements. The Pirate Bay has recently launched a challenge to the world. Behind the known site (http://thepiratebay.org), founded in 2003, offering download files, programs and films that even the principle should be paid, its creators put a check on the culture of intellectual rights launching work on the following question: Is it possible to pack all knowledge and sell it as if it were an industrial product? The hacktivism promoted by the founders of The Pirate Bay has generated unprecedented controversy over how it dealt with the knowledge. Even today, the controversy took shape and is part of extreme and warm discussions between researchers, politicians, heads of state, political activists and even the simplest web users. The controversy surrounding The Pirate Bay (TPB) has gained strength when on May 31, 2006, in Stockholm, Sweden, police raided the room of the TPB servers. About 250 to 300 servers were seized in this episode. That year, the Pirate Bay was home to approximately 150 000 titles copyrighted and received 1 to 2 million unique visitors per day. Currently, it is estimated that the site has 22 million users, is still possible to exchange music files, games, movies and software through bitorrent technology, which allows users to download files in indexed websites. "The measures taken today in Sweden serve as a reminder to pirates in the world that there is no safe haven for the Internet copyright thieves," said Dan Glickman, president and CEO of the Motion Picture Association of America - info on this documentary Steal This Film - part one (2006). The feeling I had was that the film industry - which started the pressure on politicians and authorities to take an attitude towards the issue of copyright and TPB - was gaining momentum in the war against piracy. But three days after the invasion of Pirate Bay in Sweden, the servers have been redone and most backups restored, thus allowing the operation of the site. And about a week later, the content was 100% restored. This episode only served to further encourage the sharing of files (movies, music, software, etc.), and to draw international media attention and thereby heat the debate on the issue of network sharing and law review Copyright. But this "war" between the entertainment industry and those who support the file sharing network is far from over. In April 2009, almost three years after the invasion of TPB's server room by police, the four directors of the site - Carl Lundstrom, Fredrik Neij, Peter Sunde and Gottfrid Svartholm - were sentenced to one year imprisonment and the payment of compensation valued at approximately $ 3.5 million in damages to the entertainment industry giants such as Warner Bros, Sony Music Entertainment, EMI and Columbia Pictures. At first, the postponement was due to accusations of bias against two of the main judges appointed to the appeal: Ulrika Ihrfelt and Katarina Boutz. According to formal statements of the supporters of The Pirate Bay, these judges have ties to pro-copyright. On October 6, 2009, the Appeals Court of Sweden found the allegation of 'conflict of interest "defense in relation to judges, but the decision still awaits confirmation from the Supreme Court. The trial of the directors of The Pirate Bay brings up relevant discussions about sharing and copyright. In this episode the following questions arise: if the condemnation of the leaders of the TPB is legitimized, it confirmed the victory of the entertainment industry? This struggle that the record companies and film industry wage against companies and software makers of peer-to-peer is the best solution to the current situation of copyright? And what kind of use that can be done in a given work? The exact answer to these questions do not know, but recent episodes such as Napster - the first popular Web site that allowed the exchange of audio files and that after a long court battle, its creator had considered a collaborative offender, or who contributed indirectly to the violation committed by others - show that by deleting a sharing network arise other networks that allow the same service. The music industry and major movie studios have also taken action against users who share files on the web. This attitude has gained immense dislike of Internet users and groups and entities linked to the defenses of civil liberties. Furthermore, as stated by Reinaldo Filho, "blaming only the direct offenders is nearly impossible, given the huge number of Internet users (million people) that uses technology to share digital files."&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Creative Commons - piracy, use and dissemination of works&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;In search of new solutions to the issue of copyright to the file sharing network, it is worth the alternative created for the issue of ownership of works and copyright: Creative Commons organization. This is non-profit organization and aims to expand and enhance access to creative intellectual works. To achieve this goal, explains how Ronaldo Lemos (2009), "Creative Commons has developed a series of legal licenses that allow any intellectual creator say to the community with legal validity, which can not be done with their work. There are several types of licensing, as the distribution of the work for commercial purposes without the possibility of the creation of derivative works, provided reference work from which it originated. Importantly, the use of these licenses is voluntary and it is for the author to decide what will be most interesting for access and dissemination of his work. The main Creative Commons licenses were drafted based on the North American legal model. But you have to adapt to the specificities of such licensing laws of each country. Despite being regarded as simple contracts between author and audience, it is essential that the models of the allowances to be used taking into account local laws, otherwise they become unusable. The Creative Commons is present in over 50 countries, including Brazil, where the project is coordinated by CTS - Centre for Technology and Society which belongs to the Faculty of Law of the Getulio Vargas Foundation in Rio de Janeiro. According to Lemos (2009), there are approximately 150 million works licensed under Creative Commons, as the White House website, which now use this license since the inauguration of President Barack Obama. Even with this high number of works licensed by Creative Commons, it must be remembered that there are still many artists, creators who are reluctant to release with respect to the use and disclosure of his works on the Internet. These authors have adopted the same stance of the entertainment industry and treat those who share their works as criminals, or more specifically, as pirates. The sociologist Sérgio Amadeu (2009) states that the term piracy "features the image of bloodthirsty criminals and therefore has been used." For him, "the industry of cultural mediation, affected by the expansion of digital networks, try using this metaphor to convey that sharing music with your neighbor or your brother is a heinous crime." The discussion between hacktivists, internet users, authors and entertainment industry is showing signs of that yet go a long way.
